1. Scope of Application

These General Terms and Conditions (GTC) apply to all orders placed by consumers (§ 13 BGB - German Civil Code) via the online shop HiBali Jewelry and Accesorios Shop. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed.

3. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer but an unbinding invitation to place an order. By clicking the "Buy Now" button, you place a binding order for the goods contained in your shopping cart. Confirmation of receipt of your order will be sent by e-mail immediately after submission of the order, but this does not yet constitute acceptance of the contract. We can accept your order by sending an order confirmation by e-mail or by delivering the goods within five days.

4. Prices and Shipping Costs

The prices indicated are final prices including statutory value-added tax. In addition to the stated prices, shipping costs may apply depending on the destination, which will be clearly indicated during the order process. 5. Payment

The following payment methods are available in our shop:

The purchase price is due immediately. If the buyer defaults on payment, we reserve the right to charge default interest at the statutory rate.

6. Delivery

Delivery usually takes place within 5 working days after receipt of payment, unless otherwise agreed. Deliveries are made to the address you provided. If not all ordered products are in stock, we are entitled to make partial deliveries, provided this is reasonable for you.

We currently only deliver within the EU. Should there be any delivery delays, we will inform you immediately.

7. Retention of Title

The goods remain our property until full payment has been made.

8. Right of Withdrawal

Consumers have a fourteen-day right of withdrawal. Details on the right of withdrawal and its exercise can be found in our cancellation policy.

9. Warranty

The statutory warranty rights apply. You have the right to demand rectification, replacement delivery or a reduction in the purchase price if the goods are defective. Should the defect not be remedied, you have the right to withdraw from the purchase contract.

10. Liability

We are liable without limitation for damages based on an intentional or grossly negligent breach of duty by us or our vicarious agents. Otherwise, we are only liable for slightly negligent breaches of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the customer may regularly rely. In this case, our liability is limited to the foreseeable, typical damage at the time of conclusion of the contract.

11. Applicable Law

German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

12. Dispute Resolution

The European Commission provides a platform for online dispute resolution (OS), which you can find at https://ec.europa.eu/consumers/odr. Consumers have the option to use this platform for the resolution of their disputes.

However, we are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
