1. Scope

These general terms and conditions (GTC) apply to all orders placed by consumers (Section 13 of the German Civil Code) via the HiBali Jewelry and Accessories Shop online shop . A consumer is any natural person who concludes a legal transaction for purposes that can predominantly not be attributed to their commercial or independent professional activity.

3. Conclusion of contract

The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to order. By clicking the "Buy now" button, you place a binding order for the goods in the shopping cart. Confirmation of receipt of the order will be sent by email immediately after the order has been sent, but this does not constitute acceptance of the contract. We can accept your order by sending an order confirmation by email or by delivering the goods within five days.

4. Prices and shipping costs

The prices stated are final prices including statutory sales tax. In addition to the prices stated, shipping costs may apply depending on the destination, which are clearly stated during the ordering process. You can find more information about shipping costs on our shipping costs page .

5th payment

The following payment methods are available in our shop:

The purchase price is due immediately. If the buyer defaults on payment, we reserve the right to charge default interest at the statutory rate.

6th delivery

Delivery is usually made within 5 working days of receipt of payment, unless otherwise agreed. Deliveries are made to the address you provide. If not all of the products ordered are in stock, we are entitled to make partial deliveries, provided this is reasonable for you.

We currently only deliver within the EU. If there are any delays in delivery, we will inform you immediately.

7. Retention of title

The goods remain our property until full payment has been made.

8. Right of withdrawal

Consumers have a fourteen-day right of withdrawal. Details on the right of withdrawal and its exercise can be found in our cancellation policy .

9. Warranty

The statutory warranty rights apply. If the goods are defective, you have the right to demand repair, replacement delivery or a reduction in the purchase price. If the defect is not remedied, you have the right to withdraw from the purchase contract.

10. Liability

We are liable without limitation for damages that are based on an intentional or grossly negligent breach of duty by us or our vicarious agents. Otherwise, we are only liable for slightly negligent breaches of essential contractual obligations, the fulfillment of which makes the proper execution of the contract possible in the first place and on whose compliance the customer can regularly rely. In this case, our liability is limited to the damage that was foreseeable at the time the contract was concluded and typical for the contract.

11. Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

12. Dispute settlement

The European Commission provides a platform for online dispute resolution (ODR), which you can find at https://ec.europa.eu/consumers/odr . Consumers have the opportunity to use this platform to resolve their disputes.

However, we are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
